Question for lawyers
If you have a JD but have never taken the bar exam, can someone rightly refer to you as a lawyer? Not seek legal council, but just refer to you as "a lawyer."

in this scenario absolutely not. I thought he was saying a customer or co-worker was referring to him as atty.

So the question is whether you should correct that person? If that person is referring clients your way (to seek legal advice, whether for profit or not), then you obviously will need to disclose the fact you didn't pass the bar (so you're more like a legal intern than a lawyer). If it's just coming up in casual conversation, then practically-speaking, no one cares.

This was in a newspaper article about a professor I know. He also holds a JD and they referred to him as a lawyer and professor, even though he's never taken the bar. It really doesn't matter to me. I have nothing against the guy and newspapers are known screwups. It's not like he's advertising himself as a lawyer. I was just curious about the title of Lawyer.

On a different but similar take, not all "doctors" are the same. Doctorates like being called as such but for some reason, medical doctors usually try and hide it...

If you’re admitted to a bar in any state, you can call yourself a lawyer. If you’re not, you haven't been admitted to practice law in the state, so you can’t call yourself a lawyer.

One would not want to hold yourself out as a lawyer without being admitted to practice. Being admitted involves more than just taking the bar exam, there is an separate process as well (interviews, applications, oaths, training etc.).
One way to address this frequently done by recent graduates who are in the process of being admitted is to affirmatively disclaim the fact when there may be an implication that they are an atty (for example including "*Not admitted to practice" or something similar in an email signature if sending email from a law firm account. |

It's actually pretty simple and I'm surprised no one has yet to get it correct.
A lawyer has gone to law school and possesses a J.D. An attorney has passed a bar exam and is admitted to practice in a state. All attorneys are lawyers but not all lawyers are attorneys. Despite common usage, the terms lawyer and attorney are not interchangeable. |

If you know your stuff inside and out but you're not a lawyer (e.g. you fought speeding tickets dozens of times and never lost a case), is there any law against defending someone in court or showing up on behalf of someone? If it is legal, what is that person called? No troll answers; I'd like to profit off my expertise without having to go back to school

There are tons of Jackasses who have a clinic in Los Angeles, and say they have Doctorate in their language. They only have a damn MD, and pretending to have a PhD with it.
Isn't that illegal? |
