This sounds like it may be the same problem I had in the summer. My dealership struggled for a while to find the problem and much to my dismay their solution worked. Have you changed the tyres recently as this was the cause of the whining in my case. I had different makes of tyres on the front and back which affected the transfer box and caused the whining.
In your handbook BMW recommend that you replace tyres only with ones that have a star marked on the side walls. I didn't and the dealership claimed that the differing resistance of differing tread patterns on the front and back axles is detected by the transfer box. I had to change all four tyres to ones recommended by BMW, with a star marked on the side, and it cleared the whining noise. Expensive, but the dealership did pay for two as a 'goodwill' gesture.
Apparently it was a regular occurrence on X3's before the recent facelift. Mine was the first X1 that my dealership had dealt with having this issue.
