The black scratched piece is plastic. You should be able to go to town on it, and if that doesn't work out, just replace it with a new part.

The body panels on top of the hatch and above brake lights are painted metal, and the scratches look to be contained in the clear coat layer. You should be able to polish them out without cutting through the entire clear coat layer, but that is something best left to a paint-repair shop. They may not be able to get it to 100% as-good-as-new, but will get you to within 98% of perfect.
