I think BMW would be hard pressed to blame this on him, so it would be warrantied. They had to replace my rear discs, brakes, parking brake innards, etc etc because they got stuck, broke, and warped things that shouldn't. I didn't break them, they just fell apart.
That being said as always it depends on your relationship with your stealership. I keep mine healthy for when I need it.
